Terms of Service

By downloading, accessing, or using Swim T (the “App”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the App.

These Terms apply to all users of the App and any related services provided by the developer (“we,” “us,” “our”).

1. Description of Service

Swim T provides swimming performance analysis, insights, and visualizations based on data available on your iOS device (including, where permitted, Apple Health and workout metrics). Features may include pace/split analysis and progress tracking.

We may update, change, or discontinue features at any time.

2. Eligibility

You may use the App only if you can form a binding agreement in your jurisdiction and comply with these Terms.

3. Subscriptions (Swim T Pro — Auto-Renewable)

3.1 Plans & Pricing

Swim T Pro is offered as auto-renewable subscriptions (for example, monthly or yearly plans).

Pricing is determined by Apple and may vary by country/region, currency, and applicable taxes. The price displayed on the App Store purchase screen at the time of purchase is the price you will be charged.

3.2 Billing & Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.

• Your account will be charged for renewal within 24 hours prior to the end of the current period.

3.3 Free Trials (If Offered)

If a free trial is offered:

• The free trial automatically converts to a paid subscription unless you cancel at least 24 hours before the trial ends.

• Any unused portion of a free trial will be forfeited when you purchase a subscription.

3.4 Managing, Canceling, and Restoring

• You can manage or cancel your subscription in:Settings → Apple ID → Subscriptions (or App Store → Account → Subscriptions).

• If you reinstall the App or change devices, you may restore access using Restore Purchases (if available) and Apple’s subscription management.

3.5 Refunds

All payments are processed by Apple. Refund requests are subject to Apple’s policies and must be requested through Apple.

4. Privacy

If you do not agree with our privacy practices, do not use the App.

5. Health & Training Disclaimer

Swim T is a fitness analytics tool and not a medical device. The App’s insights are for informational purposes only and are not medical advice.

You should consult a qualified professional coach or medical practitioner before starting, changing, or continuing strenuous physical activity. Use the App at your own discretion and risk.

6. Intellectual Property

The App, its name, branding, UI design, text, graphics, and any proprietary analytics or algorithms are owned by the developer and protected by applicable intellectual property laws.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from the App except where permitted by law.

7. Acceptable Use

You agree not to:

• Use the App for unlawful purposes

• Interfere with or disrupt the App or its security features

• Attempt to gain unauthorized access to systems or data

• Circumvent paywalls, subscription checks, or other access controls

• Misrepresent your identity or misuse the App to harm others

8. Availability & Changes

The App may be unavailable from time to time due to maintenance, updates, or issues beyond our control. We do not guarantee uninterrupted access.

We may change these Terms, the App, or its features at any time. Continued use after changes means you accept the updated Terms.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be error-free, accurate, or meet your requirements.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the App.

This includes (but is not limited to) data loss or performance issues caused by device problems, iOS updates, Apple Health changes, or third-party platform behavior.

11. Termination

We may suspend or terminate your access to the App if you violate these Terms or if required for legal or security reasons. You may stop using the App at any time by uninstalling it and canceling any active subscriptions through Apple.

12. Governing Law

These Terms are governed by the laws applicable in your jurisdiction, to the extent required by local consumer protection laws. Where permitted, disputes may be handled in the courts of the developer’s primary place of business.
